PROGRAM DESCRIPTION
In this day of technology advancements, it is important to remember the basics of Human Resource Management. A strong foundation of compliance supporting its vision, mission and values remains essential to any successful organization.
The Fair Labor Standards Act (FLSA) turns 80 years old this year. Though the law hasn’t changed in recent years, FLSA lawsuits continue to have a significant impact on employers. While the anticipated changes to important FLSA regulations have been blocked, HR Professionals have to consider the intersection of newer state wage laws and regulations that govern the payment of minimum and overtime wages.
Michael Abitabilo, Principal in the White Plains office of Jackson Lewis, will provide a brief update on:
- Current status of the 2016 Final Regulations regarding the so-called “white collar” exemptions.
- Applicable state regulations regarding minimum wage and overtime
- The reinstitution of DOL opinion letters
- Employee vs. Independent Contractor
In addition, Michael will provide practical guidance on lawful and effective performance management, including:
- Employment at-will
- The importance of timely and accurate performance feedback and evaluations
- How to effectively document performance issues
- Common mistakes to avoid
ABOUT THE SPEAKER
Michael Abitabilo is a Principal in the White Plains, New York, office of Jackson Lewis P.C. His practice includes the representation of management in employment litigation matters before state and federal courts, as well as federal and state agencies, including the Equal Employment Opportunity Commission, New York State Division of Human Rights, National Labor Relations Board, Department of Labor, the New York State Public Employment Relations Board, and other federal, state and local agencies. In this role, Mr. Abitabilo has extensive experience defending both single-plaintiff and multi-plaintiff discrimination/harassment cases, as well as class/collective actions.Mr. Abitabilo dedicates a substantial portion of his practice to providing advice and counsel to employers of all sizes on issues such as employee handbooks and workplace policies, wage and hour compliance, employee discipline, internal complaints and investigations, disability and leave management issues, and many other issues faced by today’s employers. Mr. Abitabilo also has significant experience in traditional and public sector labor law. While attending law school, he was a member of the Moot Court Association and served as the Editor-in-Chief of the Hofstra Labor & Employment Law Journal.
